Welcome to ReVibe Collective Shop, LLC. Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to ReVibe Collective Shop, LLC (“ReVibe Collective”).

ReVibe Collective operates this store and website, including all related information, content, features, tools, products, and services, to provide you, our customer, with a curated shopping experience (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide these Services to you.

These Terms of Service, together with any policies referenced or linked herein (collectively, the “Terms”), describe your rights and responsibilities when accessing, browsing, purchasing from, or otherwise using our Services.

Please read these Terms carefully. They contain important information regarding your legal rights and responsibilities, including provisions related to warranty disclaimers and limitations of liability.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the right to provide such information.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for all activity occurring through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make every effort to accurately describe and represent the products available through ReVibe Collective. However, colors, textures, patterns, fragrances, finishes, and other product details may vary slightly from what appears on your screen due to photography, lighting, device settings, and the handmade nature of many of our products.

Many ReVibe Collective products are handcrafted, hand-poured, handsewn, or produced in small batches. Because of this, slight variations in color, texture, appearance, pattern placement, size, finish, or other characteristics may naturally occur. These variations are part of the unique nature of handcrafted products and are not considered defects.

Fragrance descriptions and scent notes are provided as a general guide. Fragrance perception is subjective and may vary from person to person. We cannot guarantee that a fragrance will smell exactly as anticipated based solely on its name, description, or listed fragrance notes.

Product photographs are intended to provide an accurate representation of our products; however, handmade items, including handsewn goods, may not be identical to the item pictured. Fabric placement, patterns, stitching, embellishments, and other handmade details may vary unless the product listing specifically states that the exact item pictured is the item being purchased.

Customers are responsible for reviewing all product descriptions, ingredients, care instructions, warnings, and directions for use before purchasing or using a product. Personal care products should be used only as directed, and customers should review ingredient information prior to use if they have known allergies or sensitivities.

All product descriptions, fragrances, designs, packaging, pricing, and availability are subject to change without notice. We reserve the right to discontinue products or fragrances at any time and to limit quantities based on availability, seasonality, production capacity, or other circumstances.

SECTION 3 – ORDERS

When you place an order through ReVibe Collective, you are making an offer to purchase the products included in your order. ReVibe Collective reserves the right to accept, decline, modify, or cancel an order when reasonably necessary, including due to product availability, pricing or listing errors, payment issues, suspected fraud, or other circumstances affecting our ability to fulfill the order.

Your order is not considered accepted until payment has been successfully processed and your order has been confirmed by ReVibe Collective.

Please review your order carefully before submitting it, including the product, size, fragrance, design, quantity, personalization, and shipping information, as applicable. Because many of our products are handcrafted, made in small batches, or prepared specifically for an order, we may be unable to accommodate changes or cancellations once production or order preparation has begun.

If we are unable to fulfill an item or need to make a change to or cancel an order, we will make reasonable efforts to contact you using the email address, telephone number, billing information, or other contact information provided at checkout.

Custom and Special Orders: Custom products, personalized items, custom gift sets, large-quantity orders, and other special-order products may require additional processing time. Pricing, availability, product details, and estimated completion times may vary depending on the request. Once materials have been purchased or production has begun, custom or personalized orders generally cannot be changed, canceled, returned, or exchanged except in the case of an error or defect for which ReVibe Collective is responsible.

All returns, refunds, and exchanges are subject to our Refund Policy.

Unless otherwise agreed to by ReVibe Collective, products purchased through our retail website are intended for personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed and will be reflected in your order confirmation. Unless otherwise stated, posted prices do not include applicable taxes, shipping, handling, or other charges that may apply.

Prices offered through our online store may differ from prices offered at markets, festivals, pop-up events, through custom or special-order quotes, or through other sales channels. From time to time, ReVibe Collective may offer promotions, discounts, bundles, or other special pricing. Such offers may be subject to additional terms and may be changed or discontinued at any time, unless otherwise prohibited by law.

Pricing for custom orders, personalized products, gift sets, bulk or large-quantity orders, and other special requests may vary from standard website pricing. Any applicable pricing and terms will be communicated to the customer before the custom or special order is finalized.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases made through our Services. You agree to promptly update your information as necessary so that we can complete your transaction and contact you regarding your order.

You represent and warrant that the payment information you provide is true, correct, and complete; that you are authorized to use the payment method provided; and that you are responsible for all charges associated with your purchase, including applicable shipping, handling, and taxes.

SECTION 5 – SHIPPING AND DELIVERY

We make every effort to prepare and ship orders within the processing timeframe communicated on our website or during the ordering process. Because many ReVibe Collective products are handcrafted, hand-poured, handsewn, made in small batches, or made to order, processing times may vary depending on product availability, order size, customization, season, and current order volume.

Processing times refer to the time required to prepare your order and are separate from the time required for the shipping carrier to deliver your package.

All shipping and delivery dates are estimates only and are not guaranteed. Once an order has been transferred to the shipping carrier, delivery times are outside of our direct control. ReVibe Collective is not responsible for delays caused by shipping carriers, weather, natural disasters, transportation interruptions, customs processing, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address when placing an order. ReVibe Collective is not responsible for delays, failed deliveries, or additional shipping expenses resulting from incorrect or incomplete shipping information provided by the customer.

If you discover an error in your shipping information, please contact us as soon as possible at revibecollectiveshop@gmail.com. We will make reasonable efforts to update the information if the order has not yet shipped, but we cannot guarantee that changes can be made once an order has entered processing or has been transferred to the carrier.

If your order arrives damaged, defective, or incorrect, please contact us promptly in accordance with our Refund Policy so we can review the issue and work with you toward an appropriate resolution.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including but not limited to our website content, trademarks, trade names, logos, branding, text, product descriptions, photographs, images, graphics, designs, videos, audio, and the selection and arrangement of such content, are owned by or licensed to ReVibe Collective Shop, LLC, its affiliates, licensors, or other respective rights holders and are protected by applicable intellectual property laws.

These Terms permit you to access and use the Services for your personal, non-commercial use only. Except as expressly permitted by law or with our prior written consent, you may not reproduce, copy, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, sell, or otherwise exploit any material contained within the Services.

Nothing in these Terms grants you any license or other right to use any trademark, copyright, trade name, logo, design, photograph, or other intellectual property belonging to ReVibe Collective, Shopify, our collaborators, licensors, or any other third party.

The ReVibe Collective name, logo, product names, designs, slogans, photographs, and other identifying brand elements may not be copied or used without authorization where protected by applicable law.

Certain products, designs, photographs, names, or other materials appearing through our Services may be created by or attributed to independent makers, collaborators, suppliers, or other third parties. Such materials remain subject to the intellectual property rights of their respective owners.

Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, product names, designs, and trademarks appearing through the Services belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to tools, features, or services offered by third parties as part of the Services. We do not necessarily monitor, control, or have input over these third-party tools.

You acknowledge and agree that access to such tools is provided “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. To the fullest extent permitted by law, ReVibe Collective shall not be liable for any loss, damage, or other issue arising from or related to your use of optional third-party tools.

Your use of any optional third-party tools offered through our website is at your own risk and discretion. You are responsible for reviewing and understanding the terms and policies of the applicable third-party provider before using those tools.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

ReVibe Collective is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with ReVibe Collective. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and ReVibe Collective, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with ReVibe Collective.

SECTION 10 – PRIVACY POLICY

This may include, where appropriate, sharing customer reviews, testimonials, photographs, or other Feedback on our website, social media pages, marketing materials, or other promotional channels.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback you provide; (ii) you have disclosed any compensation or incentive received in connection with your Feedback; and (iii) your Feedback complies with these Terms.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

If an error affects an order you have already placed, we reserve the right to correct the error or, when reasonably necessary, modify or cancel the affected portion of the order. If an order is canceled after payment has been processed, any applicable amount paid for the canceled item or order will be refunded in accordance with our Refund Policy and applicable law.

Because many ReVibe Collective products are handcrafted or produced in small batches, minor variations in appearance, color, texture, pattern placement, or other handmade characteristics are not considered website errors or inaccuracies when they are consistent with the product description.

SECTION 13 – PROHIBITED USES

You may access and use the Services only for lawful purposes. You may not access or use the Services, directly or indirectly:

(a) for any unlawful, fraudulent, or malicious purpose;
(b) to violate any applicable international, federal, state, provincial, or local law, regulation, rule, or ordinance;
(c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

(i) to engage in conduct that interferes with another person's use or enjoyment of the Services or that may harm ReVibe Collective, Shopify, our customers, or other users of the Services.

(a) upload or transmit viruses, malware, malicious code, or other material that could interfere with the functionality, operation, or security of the Services;
(b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services except as expressly authorized by us;

(d) spam, phish, pharm, pretext, or engage in similar deceptive practices;

14.4 Agents must: (i) identify that a request is being made by an Agent and disclose the name of the Agent as required by applicable technical standards; (ii) not conceal or misrepresent that access or interaction is being performed by an Agent, including by mimicking human behavior or circumventing CAPTCHAs or similar measures intended to distinguish humans from automated systems; (iii) respond truthfully to requests intended to determine whether an interaction is coming from a human or automated system; and (iv) not bypass or circumvent measures intended to block, restrict, modify, or otherwise control automated access to the Services.

We may suspend or terminate your access to the Services, or any portion of the Services, if we reasonably determine that you have violated these Terms, applicable law, or otherwise used the Services in a manner that may cause harm to ReVibe Collective, Shopify, our customers, or others.

You will remain responsible for all amounts due through the effective date of termination.

Any provisions of these Terms that by their nature should survive termination will remain in effect, including provisions concerning Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and Privacy.

While we make reasonable efforts to provide accurate and current information, we do not warrant that all information provided through the Services will always be complete, accurate, current, or error-free.

Some jurisdictions do not allow certain limitations or exclusions of warranties. Accordingly, some of the above limitations may not apply to you, and nothing in these Terms is intended to limit rights that cannot lawfully be limited or excluded.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REVIBE COLLECTIVE SHOP, LLC, ITS AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS LIMITATION APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW, WHETHER A CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

SECTION 18 – INDEMNIFICATION

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless ReVibe Collective Shop, LLC, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, claims, and reasonable attorneys' fees arising from or relating to: (1) your breach of these Terms of Service or any policies incorporated into these Terms; (2) your violation of applicable law or the rights of a third party; or (3) your misuse of or unauthorized access to the Services.

We will provide reasonable notice of an indemnifiable claim. Failure to promptly provide notice will not relieve you of your obligations except to the extent you are materially prejudiced by the delay.

We may control the defense and settlement of such a claim, including selection of counsel, provided that we will not agree to a settlement imposing non-monetary obligations upon you without your consent, which shall not be unreasonably withheld. You agree to reasonably cooperate in the defense of any such claim, including providing relevant information or documents.

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision will nevertheless be enforced to the fullest extent permitted by applicable law. Any unenforceable portion will be deemed severed from these Terms without affecting the validity or enforceability of the remaining provisions.

These Terms of Service, together with our Privacy Policy, Refund Policy, and any other policies or operating rules posted through the Services or incorporated by reference, constitute the entire agreement and understanding between you and ReVibe Collective concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals relating to the Services, whether oral or written.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

These Terms of Service and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws applicable in the jurisdiction where ReVibe Collective Shop, LLC is headquartered, without regard to conflict-of-law principles.

You and ReVibe Collective Shop, LLC consent to the jurisdiction and venue of the courts located in that jurisdiction, except where applicable law provides otherwise.
